A brain injury can rob a person of his or her soul. It can shatter someone’s personality, change their character, destroy their memories, and limit their comprehension. In many cases involving a traumatic brain injury, the person who existed before the accident is replaced with a different person. That change can devastate not only the person who was physically injured but their family and friends.

There’s no denying just how catastrophic and expensive brain injuries tend to be. The impacts caused by a person’s head injuries and serious brain injuries can potentially last an individual’s lifetime. Even when someone may appear to recover from so-called minor traumatic brain injuries, such as concussions, accident victims can still have ongoing issues and can be much more vulnerable to future cranial deficits.

A more serious brain injury is commonly referred to as a traumatic brain injury (TBI), and victims of these brain injuries will typically endure not only physical and emotional challenges but also significant medical bills and other monetary losses. In serious TBI cases, victims often have trouble going back to their careers and finding future employment, which subsequently leads to an incredible amount of emotional distress for the accident victim and his or her entire family.

If you or a loved one has suffered from a brain injury of any kind that was caused by someone else’s negligence, it’s important that you take the proper measures to hold the negligent party accountable. You have the right to seek rightful compensation for your past and future damages. Compensation for your damages, of course, can’t necessarily undo what has been done, but it can provide the necessary financial support to receive ongoing medical treatments and ensure that you and your family are in a more stable place.

Brain Injury Informations

What is a TBI?

A traumatic brain injury occurs when an individual suffers an unexpected, sudden impact on their head, which then causes brain damage, according to the National Institutes of Health (NIH). This type of sudden force can occur in a whole variety of ways, but it goes without saying that a serious TBI is typically the result of a catastrophic accident.

Many people believe that an actual physical strike to the head is necessary to suffer a traumatic brain injury. This is not necessarily so. People can suffer a traumatic brain injury from sudden acceleration or deceleration, even when their heads do not strike an object. This is because the brain can move inside a person’s skull. For example, if a person is rear-ended in a car accident and is suddenly thrown forward and restrained against a seatbelt, the person’s brain can forcefully strike the inside of the skull, causing physical damage and even bleeding. This can cause a TBI.

It is also important to know that TBIs range all the way from mild concussions to instances in which a victim endures permanent brain damage.

The CDC has published a report estimating that each year about 2.5 million Americans go to the ER as a result of TBI-related injuries and that each year the nation suffers around 55,000 casualties and 300,000 long-term hospitalizations as a result of these serious cranial injuries.

Common Causes of Traumatic Brain Injuries

The CDC has stated that Americans over 65 are at the highest risk of enduring a TBI, and this is predominantly because they are more prone to slip and fall accidents. But of course, everyone is truly at risk of suffering a TBI, not just older people.

Brain injuries can potentially occur in a whole variety of accident scenarios, and some of the more common scenarios include the following:

Common TBI Symptoms

A lot of people who experience a TBI don’t necessarily realize it, or even exhibit symptoms right away. There are a wide variety of symptoms associated with brain injuries, and these symptoms can change and develop over time.

Symptoms typically will take adults days or even weeks to notice, and for infants and small children, it can take years for parents to recognize.

The following symptoms are some of the more commonly associated with both mild and severe TBIs:

Mild TBI Symptoms

  • Nausea
  • Consistent headaches
  • Unexplainable fatigue
  • Shoulder and neck pain
  • A ringing sound in ears
  • Dizziness/Vertigo

Severe TBI Symptoms

  • Consistent headaches or migraines that get worse with time
  • Nausea and vomiting
  • Slurred speech
  • Seizures
  • Dilated pupils
  • Numbness
  • Loss of consciousness

It’s crucial that no one ignores these types of symptoms. If left untreated these issues can potentially be debilitation or even fatal. Seeking immediate medical attention after an accident is always important, and when you or a loved one is experiencing any possible brain injury or is exhibiting TBI symptoms it’s imperative to obtain medical testing to properly evaluate the full nature and extent of any damage.

Potential Impacts of TBIs

There typically isn’t many people who can do to reverse brain damage as a result of a TBI, but medical treatment can always go a long way in terms of preventing any further brain damage and helping to control symptoms.

The overall impacts of a TBI will depend upon the severity of the head trauma the victim endured, and how long the TBI goes untreated by medical professionals.

The CDC has reported that TBI victims may experience the following long-term impacts:

  • Memory issues
  • Abnormal sensations within all senses
  • Balance and vertigo problems
  • Emotional comprehension and expression struggles
  • Communication troubles
  • Personality changes
  • Persistent vegetative state (PVS) or coma
Potential Damages When Seeking Compensation

Pennsylvania law allows you or your loved one to seek compensation for economic and non-economic damages when someone else’s negligence or recklessness caused an accident that resulted in a traumatic brain injury.

Every TBI case is unique, and the specific damages will vary from case to case. While the following types of damages are not guaranteed, they are common to TBI claims. These damages may include the following:

  • Costs of past, present and future medical treatment
  • Costs of rehabilitation services
  • Costs of assistive technology and devices
  • Lost wages and lost future earning capacity
  • Costs of home modifications and specific installations
  • Costs of replacement services
  • Non-economic damages (pain and suffering, loss in quality of life, etc.)
  • Punitive damages
  • Wrongful death
